Young Adult Alcohol Diversion Program

        The Rocky River Municipal Court young adult diversion program provides a short period of supervision and education for the purpose of assisting eligible offenders in changing the behavior that brought them before the Court.  An offender who satisfactorily completes the diversion program will receive recommendation by the prosecuting attorney to the Court that the charges against them be dismissed and the court shall dismiss the charges.

Terms and Conditions

First time offender:  I have not previously been convicted of any criminal offenses, and have not previously been convicted of any of the following alcohol related traffic offenses:  DUI/BAC/OVI, OMVUAC.  Additionally, I have no pending criminal or alcohol related traffic offenses pending against me in any Court.

Education:  I will complete the alcohol education program at Rocky River Municipal Court as scheduled and at my cost.

Community Service:  I will complete 20 hours of community service as directed by the Judge/Magistrate at my cost.

Costs:  I will pay non-refundable Young Adult Alcohol Diversion Program (YAADP) probation services fee (Judge Fitzsimmons/Magistrate Serrat’s cases $200 YAADP probation services fee payable to Rocky River Municipal Court) and all Court costs associated with my case as directed by the Court, before any charges are dismissed, unless the Court in it’s discretion waives same.

Probation:  I will report to probation as scheduled, will notify probation of any changes which will effect my ability to complete the program and any change in my address.

Good Behavior:  I understand that if I am charged with any criminal offense or alcohol related traffic offense while participating in the program, my case will be returned to the Court for appropriate further disposition.

Time Waiver:  I hereby waive my statutory right to a speedy trial and agree to sign the waiver document.  I understand that if my case is returned to the regular Court docket for any reason, this waiver shall no longer be in effect as of the date that I am removed from this diversion program.

Dismissal Hearing:  I agree to complete the education, community service and payment components of this program before my dismissal hearing date.
